Terms and Conditions

These Terms and Conditions govern the provision of Japanese language lessons offered by the tutor. By enrolling in or continuing to receive lessons, you agree to these terms in full.

1. Enrollment and Eligibility

• Enrollment is open to individuals who meet any prerequisites stated at the time of registration.
• By enrolling, you confirm you have the legal capacity to enter a contract and agree to abide by these terms.

2. Scheduling and Cancellations

• Lessons are scheduled by mutual agreement between the tutor and the student.
• Cancellations must be made at least 3 hours prior to the scheduled start time to avoid penalty.
• Cancellations made with less than 3 hours’ notice may incur a cancellation fee or forfeiture of the lesson, at the tutor’s discretion.
• In the event of tutor unavailability, a make-up lesson will be offered at a mutually convenient time, or the session may be rescheduled.

3. Fees and Payment

• Lesson fees are as listed in the current pricing section of the website.
• Payments are accepted through the following methods:
  • International bank transfer (SWIFT) in euros (EUR).
  • Domestic bank transfer in Serbian dinars (RSD).
• Payment details will be provided upon booking confirmation.
• Payments must be completed before or at the time of the scheduled lesson, unless otherwise agreed in writing.
• Any bank transfer fees, including international transfer charges, are the responsibility of the student.
• For payments in RSD, the applicable exchange rate and total amount payable will be confirmed before payment.
• Fees for missed or cancelled lessons may be non-refundable in accordance with the cancellation policy outlined in Section 2.

4. Materials and Access

• The tutor may provide learning materials, access to resources, or digital content as part of the instruction.
• Materials provided are for personal, non-commercial use and may not be redistributed or sold without permission.
• Students are responsible for obtaining any required learning tools or software unless otherwise stated.

5. Assessments and Feedback

• Periodic assessments may be conducted to gauge progress and tailor instruction.
• Feedback from the tutor is intended to support improvement and may include observations on language use, pronunciation, and cultural understanding.
• Students may request clarification or additional explanations regarding feedback.

6. Learning Obligations and Conduct

• Students are expected to participate actively, complete assigned practice, and communicate respectfully.
• Harassment, discrimination, or any disruptive behavior toward the tutor or others will not be tolerated and may result in termination of lessons.

7. Privacy and Confidentiality

• Personal information collected during enrollment will be used solely to provide and manage the lessons.
• Records of attendance and progress may be maintained for instructional purposes.
• Information will be handled in accordance with applicable privacy laws and will not be disclosed without consent, except as required by law or as necessary to protect rights.

8. Intellectual Property

1. The tutor retains ownership of all instructional materials and content created for lessons.
2. Students may not reproduce, share, or use the tutor’s materials for commercial purposes without explicit permission.

9. Limitation of Liability

• The tutor shall exercise reasonable care in delivering instruction but cannot guarantee specific language proficiency outcomes.
• The tutor is not liable for network outages, device failures, or external factors affecting access to lessons.
• Any damages arising from participation in lessons shall be limited to the fees paid for the applicable period.

10. Termination

• Either party may terminate the instructional relationship with written notice.
• Upon termination, any outstanding fees must be settled in accordance with the agreed payment terms.
• Access to materials and any ongoing support may be limited after termination, unless otherwise agreed.

11. Governing Law and Disputes

• These terms are governed by the applicable laws of the relevant jurisdiction.
• Any disputes shall be resolved amicably, and if unresolved, may be referred to appropriate legal remedies in accordance with the law.

12. Changes to Terms

• The tutor reserves the right to modify these terms. Changes will be communicated in writing and take effect for new enrollments or as stated in the notice.

13. Miscellaneous

• Entire Agreement: These terms constitute the complete agreement between the student and the tutor regarding the lessons.
• Severability: If any provision is found unenforceable, the remaining provisions shall continue in effect.
• Notices: All notices shall be provided in writing to the contact method specified during enrollment.
